Damario Smith Shooting: What Happened on MLK Drive?

Another Black life has been tragically cut short following an encounter with law enforcement in Atlanta. On April 24, 2025, Fulton County police officers shot and killed 23-year-old Damario Smith. The incident unfolded near Martin Luther King Jr. Drive SW, an area police described as known for drug activity (Fulton County police fatally shoot person near drug spot in SW Atlanta). Officers claim they pursued Smith and that he pulled a handgun during the confrontation, leading them to open fire (Fulton County police shoot, kill man who tried to pull gun on them).

However, video evidence complicates the official narrative. Bodycam footage exists, but a bystander video quickly went viral, showing Smith running from officers before getting into his car (‘Is He Dying?!’: Atlanta Cops Shoot Black Man After He Runs Away In Viral Video). Witnesses reported hearing officers yell, “Don’t do it!” moments before multiple shots rang out (Fulton County police shooting leaves one dead – HERE Atlanta). This sequence raises serious questions about whether Smith posed an immediate threat at the exact moment lethal force was used. Furthermore, Smith’s family vehemently disputes the police account, arguing he was fleeing and presented no danger (Fulton County police shoot, kill man who tried to pull gun on them).

Viral Video Fuels Outrage in Fulton County Police Shooting

The raw footage captured by a bystander rapidly ignited national attention. Posted on Instagram by Atlanta Uncensored, the clip showed Smith sprinting across a street and getting into his car just before officers fired multiple shots (‘Is He Dying?!’: Atlanta Cops Shoot Black Man After He Runs Away In Viral Video). Within hours, it garnered over 140,000 views, amplifying the community’s shock and grief.

Online commentary exploded, with many criticizing the officers’ decision to use deadly force against someone who appeared to be fleeing. Comments like, “They did not need to shoot that man like that,” reflected a widespread sentiment that the situation could, and should, have been handled differently (‘Is He Dying?!’: Atlanta Cops Shoot Black Man After He Runs Away In Viral Video). Indeed, the video’s viral spread draws parallels to the 2020 killing of Ahmaud Arbery, where graphic footage forced public reckoning and eventually led prosecutors to pursue charges after initial inaction (Video appearing to show killing of black jogger Ahmaud Arbery sparks national outrage). The power of bystander video remains a crucial, albeit painful, tool for demanding accountability.

GBI Investigation Underway Amid Family Demands

As is standard procedure in Georgia for officer-involved shootings, the Georgia Bureau of Investigation (GBI) has taken the lead on an independent review (Officials investigate Fulton shooting involving a police officer, GBI says). The GBI’s role involves meticulously collecting evidence, interviewing witnesses, analyzing available footage (both bodycam and bystander), and examining forensic details, such as the handgun reportedly recovered from Smith (UPDATE: GA man identified in officer involved shooting). Their findings are compiled into a case file, which is presented to the district attorney, who ultimately decides whether criminal charges against the officers are warranted ([PDF] Cold Case Reviews and Reinvestigations Pursuant to the Coleman).

Disturbingly, this marks the second GBI inquiry into a fatal officer-involved shooting in Fulton County within the same month. On April 18, 2025, officers shot and killed Rashan Cofield after he allegedly fired at them during an encounter initiated over jaywalking; two officers were injured in that incident (Jaywalking led to 2 officers being shot, suspect killed). Meanwhile, Damario Smith’s family, represented by his aunt Paulette Smith, is challenging the official story. They insist he posed no threat while running and are demanding transparency and accountability from Fulton County police (Fulton County Police Shooting in Atlanta’s Adamsville Neighborhood Leaves One Man Dead). Therefore, the GBI investigation carries immense weight for a community seeking answers.

De-escalation & Use of Force: Critical Questions in Georgia Police Brutality 2025

The core conflict lies between the police claim that Smith “pulled a handgun” and the family’s assertion that he posed “no imminent threat” while running away (Fulton County police shoot, kill man who tried to pull gun on them). While the GBI confirmed recovering a handgun, key details about its condition or exact position remain undisclosed pending investigation (UPDATE: GA man identified in officer involved shooting). The critical legal question, established by the Supreme Court case *Tennessee v. Garner*, is whether Smith posed an immediate threat of serious physical harm to the officers or others at the moment he was shot. Consequently, simply fleeing or possessing a weapon does not automatically justify lethal force.

This incident underscores the importance of de-escalation training. Such programs teach officers techniques to slow down encounters, use communication effectively, build rapport, and accurately assess threats to avoid unnecessary force (COPS National De-Escalation Training Network; [PDF] Use of Force and De-escalation Training). The officers’ shouts of “Don’t do it!” suggest an attempt at verbal command, a key de-escalation tactic, but the rapid escalation to gunfire demands scrutiny (‘Is He Dying?!’: Atlanta Cops Shoot Black Man After He Runs Away In Viral Video). Moreover, Fulton County Sheriff Patrick Labat himself acknowledged the need for better de-escalation training, even while noting perceived rising violence against officers (Officials investigate Fulton shooting involving a police officer, GBI says).

Echoes of the Past: Context of Black Man Shot by Atlanta Police

Damario Smith’s death doesn’t exist in a vacuum. It adds another painful chapter to Atlanta’s troubled history of police violence against Black citizens. The city is still grappling with the aftermath of the 2020 killing of Rayshard Brooks by Atlanta Police Officer Garrett Rolfe outside a Wendy’s. That shooting ignited massive protests, led to the police chief’s resignation, and resulted in murder charges against Rolfe, though he was later reinstated (Killing of Rayshard Brooks – Wikipedia; Atlanta police chief resigns). The circumstances, involving a Black man, police confrontation, and disputed use of force, resonate strongly with Smith’s case.

More recently, in 2022, Atlanta police faced significant backlash for shooting Nygil Cullins, a mentally ill Black man experiencing a crisis at a Buckhead restaurant (Atlanta Police Facing Anger Over The Shooting Of Mentally Ill Black Man). His family argued police failed to de-escalate and unnecessarily resorted to deadly force, leading to protests and a lawsuit (Buckhead steakhouse 2022 shooting: APD defends response). Beyond Atlanta, concerns about racial bias in Georgia policing were highlighted in 2023 when the Villa Rica Police Department faced outrage for using shooting targets depicting a Black man in training, forcing an apology and policy change (Georgia community outraged over police department’s use of Black man’s image on shooting targets). Thus, these incidents form a disturbing pattern that fuels community distrust.

Fani Willis’s Role and the Path Forward

Once the GBI completes its investigation into the Damario Smith shooting, the case file will land on the desk of Fulton County District Attorney Fani Willis (Fulton County Police Fatally Shoot 24-Year-Old Man Following Chase). Willis holds significant prosecutorial authority and discretion in deciding whether the officers’ actions warrant criminal charges. She is no stranger to high-profile, complex cases involving scrutiny of law enforcement or racial justice issues.

Willis notably prosecuted the killers of Ahmaud Arbery, securing murder convictions against the civilians involved (Read the full decision by state appeals court removing Fani Willis). She has also demonstrated a willingness to utilize powerful legal tools, like Georgia’s RICO statute, in major prosecutions (Meet Fani Willis, the Atlanta DA prosecuting Trump’s election case). Her office will carefully review the GBI’s evidence, including the videos and witness accounts, to determine if the officers violated Georgia’s laws regarding the use of deadly force. Nevertheless, the community, already weary from past incidents and demanding justice for Damario Smith, awaits her decision with intense anticipation.
